Monitoreo “pasivo” de comunicaciones: una maniobra lícita de inteligencia para la supervivencia del Estado

Resumen
La función constitucional y legal de inteligencia cuenta con un portafolio de actividades secretas y el poder para incursionar, entre otros, sobre el derecho a la intimidad. De hecho, la Ley 1621 de 2013 creó el monitoreo “pasivo” del espectro electromagnético, cuyos límites, alcances y doctrina serán forjados en el presente documento, dado su escaso avance, al tiempo que el secreto opera sobre el contenido de esas maniobras, mas no sobre su existencia.
El presente itinerario argumentativo revelará que esta institución: es vital para descifrar amenazas y riesgos que transitan por el espectro radioeléctrico, a partir del rastreo aleatorio de comunicaciones ilegales; no requiere orden judicial; garantiza el respeto de derechos fundamentales; se desarrolla por un espacio de “tiempo minucioso” y sus resultados no configuran elementos probatorios, sí criterios orientadores para la acertada toma de decisiones o una eficaz investigación criminal; por estas razones no implica una interceptación telefónica.

Abstract
The constitutional and legal function of Intelligence has a portfolio of secret activities and the power to act, among others, over the right to privacy. In fact, Law 1621 of 2013 created the “passive” monitoring of the electromagnetic spectrum, whose limits, scope and doctrine will be construed in the present document, given its little progress, while secrecy operates on the content of these maneuvers, but not on their existence.
The present argumentative path will reveal that this institution is vital to decipher threats and risks that pass through the radioelectric spectrum, from the random tracking of illegal communications; it does not require a court order, guarantees respect of fundamental rights; it is developed by on a “meticulous time” frame, and its results do not constitute evidence elements, but guiding criteria for the correct decision making or an effective Criminal Investigation. For these reasons, it does not imply wiretapping.
