Resumen
El estudio planteó el papel del Estado frente al espectro radioeléctrico, para su discusión y análisis. Con tal objetivo se realizó una investigación bibliográfica y jurisprudencial, analizando los pronunciamientos más relevantes, lo que permitió concluir que si bien el espectro radioeléctrico reviste un carácter de bien demanial, no es asà para los servicios derivados de su uso que poseen naturaleza de privados, los cuales en virtud de su relevancia se regulan por normas de derecho público. El Estado, como administrador de dicho recurso, posee potestades como: de emitir normativa; de administración, que incluye la potestad de planificación y gestión; de imponer cargas económicas, que se refiere a la creación de impuestos y cobro de cánones; y, por último, la potestad sancionatoria, que corresponde a la facultad de imponer sanciones y medidas cautelares, todo ello en los términos establecidos en la ley.

Abstract
The objective of this document is to raise the issue of the role of the State in the radio spectrum for its discussion and analysis. To achieve this, research a bibliographical and jurisprudential was carried out analyzing the most relevant pronouncements that allow to conclude that, although the radioelectric spectrum has a character of public good, is not so for services derived from its use that have private nature, but that for its importance they are regulated by the rules of public law.Th e State as administrator of such a resource has powers such as: the power to issue regulations, administrative power, including the power of planning and management, power to impose economic burdens, which refers to the creation of taxes and collection of fees and, for latest; The sanctioning power, which corresponds to the power to impose sanctions and precautionary measures, all in the terms established in the law.
